❗️JUDICIAL OVERREACH: Why are we seeing lawfare and rule by judicial decree, despite a resounding victory in the 2024 election by @realDonaldTrump? More reasons than seconds in an hour—but here’s a big one: A thread🧵

We have brought up generations of lawyers—conservative and liberal, but especially conservatives—who have became infatuated with the idea that becoming a federal judge or a Justice on the Supreme Court is the penultimate accomplishment of the best and brightest.

That idea— stemming from the ideological fallacy that Article III is somehow intellectually superior and more prestigious than Articles I and II—is incoherent, indefensible, and inconsistent with what the Founding Fathers understood. That having a “record” is somehow a liability. That zealous advocacy for a client is somehow not honorable.

We are witnessing the results of DECADES of lawyers who don’t understand the roles of Articles I or II. And who don’t do anything of significance with their God-given talents for fear of actually having a record of standing for SOMETHING.

The Constitution envisioned something so different. Ambition countering ambition, as James Madison described. Instead, we have inculcated a spineless, weak-kneed ideology in our best and brightest that exudes deference to Article III in all matters. As if elections didn’t matter. As if the other branches didn’t exist.

Hamilton described in Federalist 78 that the judiciary would be the least powerful of the branches. But instead, we have an imperial judiciary that views itself as the ultimate arbiter of EVERYTHING. And legions of so-called conservative lawyers who are thrilled to adjust their behavior and say “okay—just stop hitting me.”

The American people demand accountability. They demand change. The Constitution requires a system of checks and balances—not a system of; - rule by judicial fiat. - “oh my God, this judge in Maryland just said X.” - “who did you clerk for?” - “what will my friends at the country club say?”

Fix the culture of the conservative legal world = save the country. Accept the status quo = acquiesce to perpetual rule by whatever the latest woke ideology preaches. We have a decision to make.
