1) 24 hours ago, Bloomberg publishes a story saying a $100,000 fee on H1-Bs is ready and coming. Lots of confusion. For context, this would effectively gut the program, which is a backbone for employment-based immigration in a global race for talent world.

2) In the Oval, after rolling out the Gold/Platinum "cards", the Secretary of Commerce and White House staff say this is $100k annually, per visa. Secretary was clear he thought companies could "pay $100,000 a year for your H-1B visa.”

3) Then, the text came out. The text makes clear that this attempts to invoke the 212(f) authority and this is best describes as an entry ban on people with H1-B visas, unless you pay $100,000 *or* the government decides you or your company should get an exemption.

This entry ban goes into effect midnight tonight. This is very bad. It is also not what the Secretary or WH staff initially described. I couldn't tell you why the difference, but that is why the initial press coverage (rightly based off of the statements) vs EO text is changing.

The text is an imminent threat to anyone outside US on an H1-B this week, and a full frontal effort to eliminate the use of the visa category moving ahead, and for those who have it in the US, absolutely terrible. Imagine having to pay $100k to go see your parents and return.

There is a ton that is uncertain in it, but that leads us to overnight and today, as efforts to try to show it in a softer light.

4) Now, press are reporting that anonymous sources are saying that entry ban will not apply to anyone who has a visa already. Is that bc of the massive pushback? Bc of the likely chaos coming in hours at airports? I don't know. But but but...

Key points -Unnamed WH staff talking to reporters does not create written policy guidance, and it doesn't change written EOs -There is in fact, as of now, no guidance to officers on what to do on any of this

5) So where are things as of 2pm EST? -Chaos likely short term -It is an effort to slash this central talent pipeline to the US via an entry ban -Litigation could happen, but in this new world of no nationwide injunctions, even relief could be very limited.

Critical part of the President's new $100,000 charge for H1-B visas: The Administration can also offer a $100,000 discount to any person, company, or industry that it wants. Replacing rules with arbitrary discretion. Want visas? You know who to call and who to flatter.

She is paid millions of dollars a year by the right’s premiere media outlet and went out of her way in a scripted monologue to praise violence directed at someone she disagrees with about politics.
