1️⃣ The Setup: This “amendment” gives Ghana’s Cyber Security Authority (CSA) more power than ever. They can now act like the police, the judge, and the rule-maker all at once. The million-cedis question is, who’s making sure they don’t go too far? How far is too far? 🤔
2️⃣ Police powers: Under this new law, CSA officers can search, seize, and arrest even without traditional police involvement. They can walk into offices “at any reasonable time” and confiscate your devices in the name of an “investigation.” They’ll never abuse that power… right?
Side note: Interfering with, obstructing, or assaulting a CSA officer performing official duties can lead to up to 5 years in prison or a fine of up to ₵240,000 (20,000 penalty units) under Section 59A(1)(d) of the Cybersecurity (Amendment) Bill 2025.
3️⃣ Warrantless entry: The law allows CSA inspectors to enter workplaces without a warrant if they “reasonably believe” you’re not following their rules as long as they give a 7-day written notice. Homes are excluded, but offices, data centers, and startups are fair game. 👍🏾
4️⃣ Freeze first, ask later: The Authority can freeze your bank accounts or seize your property if they suspect you of cybercrime before any court decides if you’re guilty. They can even hold or access your data “to recover evidence.” All I see is punishment before proof 🥲
5️⃣ Licensing chokehold: No one can offer cybersecurity services even NGOs or freelancers without CSA approval. This could silence independent experts or punish critics. Basically, they decide who gets permission to work. No licence = no job.
6️⃣ “Critical systems” = anything they say it is. The law lets them label any digital service or business as “critical infrastructure.” That could include banks, schools, ISPs, fintechs and even startups. Once labeled, the CSA can monitor or control your operations. 🧐
7️⃣ Intelligence agencies at the table: The National Intelligence Bureau (NIB) and National Signals Bureau (NSB) will sit on the CSA board. Civilian cybersecurity is merging with state surveillance(spy agencies). They’ll have eyes on private sector systems too. Think about this.
8️⃣ Power to decide which technologies are allowed: CSA will “certify” AI, blockchain, cloud, and IoT tech. Translation: The government decides which technologies are “safe” to exist and which ones gets blocked. That kills innovation and creates control over digital freedom.
9️⃣ Private inspections CSA officers can demand data, audit your systems, or make copies of your files during checks. If you refuse, it’s a criminal offence. No independent oversight. Refusing to hand over data/information: fines up to ₵120,000 or 3 years imprisonment.
Side note: The Bill provides no independent oversight over these inspections beyond internal CSA authorization. There’s no outside body checking these inspections, only the CSA itself decides when and how they happen.
🔟 Conflicts of interest CSA will collect money from certification and licensing fees meaning the same body that polices you also profits from regulating you. In other words, the CSA both regulates who can operate (policing role), and earns revenue from the very licences.
Final Thoughts: The Cybersecurity (Amendment) Bill 2025 goes far beyond protecting citizens from hackers. It gives government sweeping powers over data, technology, and even who gets to work in the digital space.
Some of these powers are necessary for national security, but without strict oversight, clear limits, and judicial control, they can easily become tools for surveillance and abuse. Ghana needs cybersecurity laws but not at the expense of privacy, free speech, and innovation.
