At the outset of the current Trump administration, I had an op-ed in the WSJ on how law firms who terrorized the Trump 1 were signaling their Trump savvy to clients. I explained why that was a joke. Well, in today’s WaPo it seems some firms got the message. 1/12

Much of my piece involved how Biglaw gave Trump 1 alumni the cold shoulder, but I also discussed how Biglaw’s pro-bono industrial complex had fielded an army against Trump 1 and might do the same this time. 2/12

Of course none of this is free—it’s cross-subsidized by the paying clients. I wondered if it’s really in those paying clients’ interests, under Republican government, to be represented by institutionalized Democrat impact litigation shops. 3/12

Well it seems Biglaw and their clients saw the light. According to the Post, Biglaw firms that staffed the Resistance are largely sitting out on the No Kings movement. 4/12

This matters because subsidized Biglaw resources are a key component of liberal cause litigation and were an important component of the Resistance last time. 5/12

Biglaw let leftist impact litigators rely on their cohorts of young liberal associates looking for a break from securities litigation to help with the big cases. 6/12

In the end this was a force-multiplier for the legal left, and one of its main structural advantages. 7/12

It seems to be diminishing. This is a good thing for firms and their clients. 8/12

That doesn’t mean firms shouldn’t oppose the administration. This anecdote about Skadden seems basically fine. It’s not a cause but a case and pro bono is an important way for actual cases to get a competent day in court. 9/12

But the union between Biglaw and left-wing causes is a different matter altogether. And my heart breaks that the ABA couldn’t find counsel for its anti-Trump litigation. I’m so sorry this is happening to them. 10/12

Perhaps they should ask for advice from the LDS Church after Prop 8 or from @JeffClarkUS? This has been par for the course for conservatives for decades. Maybe the ABA should have said something about it then? 11/12

It’s good to see the legal profession inch toward political neutrality and pluralism. We’ll see if it continues as the beneficiaries of the old regime realize that they may have killed the golden goose. 12/12

@mike_frags @HarmeetKDhillon I’d feel sorry for them, but I’m too busy remembering that time the left went after the law licenses of attorneys representing conservatives circa 2020-21.
